How Private Service Works in Each State
Each state has its own rules for who may serve papers. Here is the short version, with the official rule linked.
Louisiana
The sheriff normally serves papers. If the sheriff has not served them within 10 days, or reports that service failed, the court can appoint a private process server at a party’s request. A Louisiana-licensed private investigator is presumed qualified for the job.
Code of Civil Procedure art. 1293Mississippi
Papers can be served by the sheriff on request, or by any person who is at least 18 and is not a party to the case.
Rules of Civil Procedure, Rule 4Alabama
A private process server must be at least 19, must not be a party to the case, and must not be closely related to the party asking for service.
Rules of Civil Procedure, Rule 4Step by Step
